Punishment of The Thief According To Quran...

5:38 Sura Al Maida

Thief whether Male or female(both should be given the punishment to cut their power of theft) means to imprison them. This punishment order is from Allah of Qata e Yad is as per crime.

Because Allah is Azeez and Hakeem. 5/38

If any of them make Toba after making this crime (theft) and makes his Islah then no doubt Allah cover up the wrong doings and is Raheem . 5/39

Examle :- Sura Ankaboot 29/29

Such is your condition that you go to men for sexual satisfaction and not women(7:80—81).in this way you cut the way which nature has provided for procreation.

Clarification :- This cut doesn’t mean to cut with knife or spade.

Example 5:33 Here also doesn’t mean to butcher the hands of the living persons and to make them useless for the whole life. But its mean is to imprison them.

So in 5:38—39 is against the meaning of cutting the hands of the thief.

Gaza ambema kasa bun nakaal um e nullah hay.

Means punishment subject to the volume of crime.(Neither less nor more).

Please ponder whether to cut the hands of a person who has stolen Rs. 1000 and also of a person who has stolen Rs 100,000 or two lacs or ten lacs.

If the punishment is to increase or decrease few inches up and down the length of hands to be cut becomes humorous or jokey. This doesn’t fulfil the requirement of the Divine order.

Therefore Qata e Yad is not to cut the hands but to stop the power of the theft.

Its application would be to give punishment subject to the volume of the crime.

If the theft is Rs 500 . Say the punishment is for 3 months

If the theft is one lac should be assessed accordingly.

Wallaho Azeezun Hakeem

Allah is Ghalib and Hakeem.

It is to be ordered to cut the hands of the thief and to keep the children of the thief fasting or starving and to make them beggars and liability on the society is no Hikmat

Hikmat means no wastage but to solve the problems’

In Germany the thief is to go through the training course in the ISlah Khana(Jail). The certificates issued in the jail is from the central government.

During the training of the thief his children are financially supported by the German government.
